Durham Police had to bust the window of  a vehicle in the express lane of Highway 401 Tuesday evening after they discovered a man slumped over the wheel and unresponsive.

The 26 year-old Toronto man was subsequently charged with impaired driving.

Police say officers travelling eastbound near Thickson Road in Whitby thought the car was not moving at all when they first spotted it but soon found it was slowly moving forward with the driver observed “slumped over the steering wheel.” Officers then pulled in front to stop the vehicle’s progress and then smashed the window to gain access after receiving no response from the driver.

The driver was charged with impaired operation and fail to comply with demand and his vehicle impounded and license suspended.

The driver refused to provide breath samples and was released on a promise to appear,
